What These Cases Look Like

What injury cases in Henderson
actually look like.

Henderson is Nevada's second-largest city, with its own police department, its own courts and a road network that mixes freeway, wide suburban parkways and quiet master-planned neighborhoods. Each setting produces a different kind of claim.

01.

I-215 and I-11 Freeway Crashes

The beltway carries commuters between Henderson, the airport and the southwest valley, and I-11 carries Boulder City and Hoover Dam traffic. Freeway crashes are often worked by the Nevada Highway Patrol rather than Henderson Police, which changes where the report comes from.

02.

St. Rose and Lake Mead Parkway Collisions

Wide arterials with long signal cycles, heavy left-turn traffic and constant shopping-center driveways. Turning and red-light collisions are common, and nearby business cameras can settle fault if the footage is requested before it is overwritten.

03.

Galleria and District Premises Injuries

Retail and dining areas such as the Galleria at Sunset and The District at Green Valley Ranch see falls in parking lots, on wet entry tile and on poorly lit walkways. These are premises liability claims, and the incident report belongs to the property.

04.

Lake Mead and Lake Las Vegas Recreation

Boating, personal watercraft, trail and resort-pool injuries. Lake Mead National Recreation Area is federal land, so a claim against a federal agency or employee follows the Federal Tort Claims Act and its own written claim process.

05.

Pedestrian and Bicycle Injuries

Green Valley, Anthem, Inspirada and Cadence bring school zones, crosswalks and trail crossings onto busy collector roads. Pedestrian and cyclist injuries tend to be serious even at moderate speeds.

06.

City Vehicle and Public Property Claims

A crash with a City of Henderson vehicle, or an injury caused by a public road or facility, follows Nevada's separate claim process for political subdivisions, and statutory limits on damages can apply.

Nevada Law

How Nevada law applies
to a Henderson claim.

Henderson has no injury law of its own. The same Nevada statutes that govern a Strip crash govern a crash on Eastern Avenue, and these five shape most of the value in a Henderson case.

Filing Deadline

Two years from the date of injury

Most Nevada personal injury claims must be filed within two years. Miss the deadline and the claim is generally barred, no matter how clear the fault. Different rules can apply to minors and to claims against a public body, so the date should be confirmed early.

NRS 11.190(4)(e)

Comparative Fault

Modified comparative negligence (51% bar)

You can recover if your share of fault is not greater than the combined fault of those you are suing, and your damages are reduced by your percentage. At 51 percent or more, recovery is barred. Insurers know this, which is why fault gets argued so hard.

NRS 41.141

Who Pays

The wrongdoer, and often the employer

Nevada's general injury statute makes the person whose wrongful act or neglect caused an injury liable for the damages, and makes an employer responsible for that person's conduct liable too. A delivery driver's crash on Lake Mead Parkway can reach the company's commercial policy.

NRS 41.130

Insurance Minimums

25 / 50 / 20 liability coverage

Nevada drivers must carry at least $25,000 per person and $50,000 per accident for bodily injury, plus $20,000 for property damage. Serious injuries outrun those limits quickly, so your own uninsured and underinsured motorist coverage is often where real recovery comes from.

NRS 485.185

Claims Against the City

A separate process for public entities

A tort claim against a Nevada political subdivision, such as the City of Henderson, must be presented to its governing body within two years. Damages against public entities are also subject to statutory limits under NRS 41.035, which affects how these cases are valued.

NRS 41.036

Henderson, Specifically

Why a Henderson claim is built differently.

The legal rules are statewide. What makes a Henderson case its own is who investigated it, where the records live, and which property or agency controls the evidence. Getting those details right in the first few weeks is most of what separates a well-documented claim from a thin one.

Which agency wrote the crash report

Crashes on Henderson city streets, such as Sunset Road, Green Valley Parkway, Stephanie Street or Horizon Ridge Parkway, are usually investigated by the Henderson Police Department. Crashes on the freeways, including I-215 and I-11, are often handled by the Nevada Highway Patrol. Crashes just outside city limits can fall to the Las Vegas Metropolitan Police Department. Each agency has its own request process and its own timeline for releasing a report.

Knowing which agency responded matters for more than paperwork. Body-worn camera footage, 911 audio and officer notes are held by the investigating agency, and some of that material is only kept for a limited time. A request sent to the wrong agency is a request that never arrives.

Henderson Justice Court, district court, or neither

Most Henderson injury claims are resolved with the insurance company before anything is filed. When a lawsuit is needed, the amount in dispute decides the courthouse. Henderson Justice Court hears smaller civil cases arising in Henderson Township, including small claims. Injury cases seeking more than the justice court's limit are filed in the Eighth Judicial District Court in Las Vegas, which serves all of Clark County.

Traffic citations are a separate track. A ticket issued by Henderson Police is generally handled in Henderson Municipal Court, and that court does not decide who pays for your injuries. How the other driver resolves the ticket can still matter to the civil case, so it is worth following.

Lake Mead, Lake Las Vegas and the federal question

Henderson sits next to Lake Mead National Recreation Area, which is run by the National Park Service. If an injury there involves a federal employee, vehicle or facility, the claim generally runs under the Federal Tort Claims Act. That requires a written administrative claim to the federal agency, generally within two years, before any lawsuit can be filed, and the federal rules differ from Nevada's in important ways.

Not every injury at the lake is a federal claim. A private marina operator, a boat rental company or another boater is usually handled under ordinary Nevada negligence law. Lake Las Vegas, by contrast, is a private resort community, so a fall at a hotel pool or a restaurant there is a premises liability claim against the property owner or operator.

Insurance in a 25/50/20 state

Nevada's minimum liability limits are low compared with the cost of an emergency room visit, imaging and a few months of therapy, let alone surgery. When the at-fault driver carries only the minimum, the claim against their insurer may be settled for the policy limit and the rest of the recovery has to come from somewhere else.

That somewhere else is usually your own underinsured motorist coverage, and in some cases a commercial policy if the at-fault driver was working. Reviewing your own declarations page early shows what is actually available before anyone signs a release.

The Process

How a Henderson case
actually moves.

Every case is different, but most follow the same arc. Timing depends on how long medical treatment takes and how hard the insurer contests fault.

STEP 01

Records & preservation

Identify the investigating agency, request the report, and send preservation letters for business, HOA and doorbell camera footage. Many systems overwrite video within weeks.

STEP 02

Treatment to a stable point

Claims are not negotiated while injuries are still changing. Value follows the full medical picture, including future care your doctors recommend.

STEP 03

Demand & negotiation

A demand package goes to the insurer with medical records, bills, lost-wage proof and the liability analysis. Underinsured motorist claims are opened in parallel where limits are low.

STEP 04

Filing if it stalls

If the insurer will not pay fair value, the case is filed in the right court, usually the Eighth Judicial District Court. Many cases resolve during discovery.

FAQ

Henderson questions
that come up first.

The questions Henderson clients ask most often before the first call. If yours is not here, the call is what it is for.

Does the firm have an office in Henderson?+
No. Henderson clients are served from the Las Vegas office at 7160 Rafael Rivera Way, Suite 300, Las Vegas, NV 89113, which is a direct drive on the I-215 beltway. Most cases start with a phone call, and the consultation is free.
Is Henderson law different from Las Vegas law for an injury claim?+
No. Personal injury claims are governed by Nevada state law, so the two-year deadline, the 51 percent comparative fault bar and the insurance minimums are the same. What differs is the police agency, the local court for smaller cases, and city rules such as leash ordinances.
How do I get a Henderson Police crash report?+
Reports for crashes investigated by Henderson Police are requested from the Henderson Police Department, not Las Vegas Metro. If the Nevada Highway Patrol handled a freeway crash on I-215 or I-11, the request goes to NHP instead. The report number on the card the officer gave you shows which agency responded.
How long do I have to file an injury claim in Henderson?+
Generally two years from the date of injury under NRS 11.190(4)(e). Claims against the City of Henderson or another public body follow a separate procedure under NRS 41.036, and minors can be subject to different rules. Confirm the exact deadline early rather than late.
What if I was partly at fault?+
Nevada uses modified comparative negligence under NRS 41.141. If your share of fault is not greater than the other side's, you can still recover, reduced by your percentage. If it is greater, recovery is barred, so the fault analysis is often the most important part of the case.
I was hurt at Lake Mead. Can I bring a claim?+
Possibly, but the path depends on who was responsible. Claims involving a federal employee or facility generally go through the Federal Tort Claims Act, which requires a written claim to the agency first. Claims against a private boat rental, marina operator or another boater usually follow Nevada law.
I fell at a store near the Galleria or The District. What should I do?+
Report the fall to the manager, ask that an incident report be written, photograph the floor and the area, and get names of any witnesses. The property controls its own camera footage, so a written preservation request should go out quickly.
Will my case end up in Henderson Justice Court?+
Most injury cases settle without any lawsuit. When a case is filed, smaller claims can be heard in Henderson Justice Court, while larger injury claims are filed in the Eighth Judicial District Court, which serves all of Clark County.
What does it cost to hire the firm?+
The consultation is free. Personal injury cases are handled on contingency: 33.33 percent if the case resolves before litigation and 40 percent after a lawsuit is filed. There is no attorney fee unless there is a recovery.
