Understanding Nevada's Car Insurance Minimums

Nevada requires automobile liability insurance. The policy must carry a minimum of $25,000 for bodily injury or death of one person in any one accident and $50,000 for bodily injury or death of two or more persons in any one accident. Lastly, you are also required to have $20,000 for injury to or destruction of property of others in any one accident. This insurance is commonly known as a 25/50 insurance policy.

Just because car insurance is required by law in Nevada it does not necessarily mean that everyone on the road has car insurance. Vegas car accident attorneys will always recommend that you add UM/UIM coverage to your car insurance policy. UM/UIM is short for uninsured motorist coverage.

This coverage protects you for that incident where you are involved in a car accident but the other driver has no insurance or is underinsured. Underinsured means they have insurance but the coverage is not enough to cover the damages. It’s recommended that you add this coverage to your car insurance in the event of a serious car accident that results in damage and medical bills that go beyond what the at-fault driver’s insurance will cover.

Nevada is an at-fault based insurance state. This means that the driver who was responsible for the collision pays for the damages they caused. If found 100% at fault, then their insurance company will pay for 100% of the damage. Nevada uses contributory negligence law, meaning that they use a sliding scale of responsibility and that if you were found responsible for a percentage of the car collision, then your damages will be reduced by that same percentage. The most important part, if your percentage of at-fault is greater than the other party, you can be barred from any recovery of damages. Fault will be determined by reviewing the evidence the investigation produces such as: police report, witness statements, and photographic evidence from the scene. Also, driver statements will be included in the investigation as well as road conditions.
